About Panerai and these Conditions of Sale

These Conditions of Sale apply to any sales of Panerai products or services that you may order from Richemont Suisse S.A., using the website www.panerai.com/ch and any associated mobile or digital applications that refer to these Conditions of Sale (together, the “Platforms”) or by telephone via our client relations center (the “Client Relations Center”).

Richemont Suisse S.A. has its registered offices at 9, route des Biches, 1752 Villars-sur-Glâne, Switzerland (“Panerai” and "we", "us" and "our"). Our VAT number is CHE-102.738.465.

Richemont Suisse S.A. is an affiliate of Terms of Use entity, which owns and edits the Platforms pursuant to the Terms of Use, and Privacy Policy entity, which is responsible for our information collection practices pursuant to the terms of the Privacy Policy. By placing an order, you agree to be bound by the Terms of Use and Privacy Policy, the terms of which are incorporated into these Conditions of Sale.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Platforms or Client Relations Center (together the “Sales Channels”). Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Sales Channels. Sales concluded through physical points of sale (such as our retail boutiques) or third parties (such as authorized retailers) are not subject to these Conditions of Sale. 

Updates to these Conditions of Sale

We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on the Platforms. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as from that date. Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

Purchasing eligibility

Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries);  (b) have legal capacity to enter into contracts; and (c) use a shipping address in the country or countries that we ship to (as specified by the Sales Channels), may order products through the Sales Channels. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.

Product availability & quantity

All orders placed through the Sales Channels are subject to availability and acceptance of such orders by us. Products shown on the Platforms, which cannot be added to the shopping bag, are not available for sale via the Platforms. The Client Relations Center can provide more information as regards these products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products. We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

Currently orders may not exceed 4 products (1 watch and 3 accessories) – products in any buying session on the website or through the Client Relations Center.

The Client Relations Center and the product pages of the Website can provide you with information regarding products that are currently available for sale through these channels.

Account registration & guest checkout

To place an order, you may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s).

Creating an Officine Panerai online account will enable you to save your Wishlist and Comparator lists and access the history of your transactions from the date of creation of your account. 

Personalized services

Personalization services (for example engraving or embossing) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details in the Sales Channels as requested.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund, as described in these Conditions of Sale. This does not affect your consumer rights (please see the Manufacturer’s guarantee and your legal consumer rights section below for further information).

Order Process

The order process of the Platforms will include the following:

·            Add to Shopping Bag: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits). Placing an item in your shopping bag does not guarantee availability for purchase, which is not confirmed until you receive a written Confirmation of Order & Shipment.

·            Guest/My Account Checkout: When you are ready, you then proceed to “Checkout”, either as a guest or through your registered account. You may also remove one or several products you have selected from the shopping bag as part of the checkout process. 

·            Delivery, Review and Payment: As part of the checkout process, you add and review your order details and personal information (including e-mail, shipping address, billing address and payment information). You should carefully check and confirm all details on the order summary page before placing your order. 

·            Placing of Order: You then check the relevant box and place your order.

In the case of an order being placed through the Client Relations Center, the Panerai ambassador will walk you through the steps above and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; or (ii) have otherwise violated these Conditions of Sale.  

Prices, taxes and shipping costs

All prices shown on the product pages of the Platforms or quoted by the Client Relations Center are in Swiss Francs (CHF) and include the applicable VAT, but exclude shipping costs and other taxes unless otherwise stated.

Shipping costs, if any, are described in the Shipping Policy below or on the Sales Channels. Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options. These costs will be summarised before you are asked to confirm and place your order and will also be reflected in our email correspondence with you once you have chosen your delivery options.

We may offer a VAT refund mechanism if you decide to have the products delivered in Switzerland and, no longer than thirty (30) days afterwards, export them outside Switzerland upon certain conditions. For details, please refer to our FAQs section or contact our Client Relations Center.

We reserve the right to modify prices and delivery costs at any time without prior notice.

We take reasonable care that the prices of products and delivery costs are correct at the time when the relevant information was entered into the system or communicated to you via the Client Relations Center. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Sales Channels or delivery costs may be incorrectly priced. If any of the products you place an order for or any delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel supply of the product and refund you any sums you have paid.

Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order. 

Payment

We accept the methods of payment identified as part of the order process via the Sales Channels. Depending upon the means of payment, we may require additional information, including specific forms of identification.

When ordering on the Platforms, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your complete payment details. All payment card holders are subject to validation check and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

 

 

Other payment methods may also be subject to validation checks and authorization by the payment system providers as well. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card details, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

The full amount of your purchase will typically be blocked on your payment card until your order is shipped, at which point you will be sent a Confirmation of Order & Shipment and your payment card will be charged the applicable purchase price.

Where we offer PayPal as a payment method, the full amount of your purchase may be debited on your payment card immediately following the placement of your order. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

We may accept bank wire transfer for orders at our sole discretion. We do not charge a fee for bank wire transfers for orders made through the Sales Channels or Client Relations Centre, however, some financial institutions may charge a fee for using a bank wire transfer. We require that all bank wire transfer orders placed by telephone be confirmed through an order approval process. We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by e-mail. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

Acknowledgement of Order

 

Once you have made your choice and your order has been placed through the Sales Channels, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. This Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order. If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Customer Relations Centre promptly. 

These Conditions of Sale will be provided to you when we acknowledge your order.

 

 

Shipping Policy

Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract.

Delivery

We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our written Confirmation of Order & Shipment and in any event within thirty (30) days after that date, except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications. 

When ordering through the Sales Channels, you may be able to choose a specific delivery date as available on the Sales Channels. Any such specific delivery date remains subject to our confirmation.

If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimise the effect of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other time limit as indicated by us, you may contact the Client Relations Center to cancel the relevant order and get a refund of any sums you pre-paid us for any products which you have not received. 

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

 

 

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

We will require a handwritten or electronic signature by you, or a person at the nominated delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfilment of the sales contract by Panerai and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver the products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products. Please refer to our FAQs section or call the Client Relations Center for more information.

Invoices

When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise). 

Returns and Exchanges

(a)    Right to cancel

You have the right to cancel the contract created by our written order confirmation without giving any reason fourteen (14) days from the day on which you acquire, or someone you nominate (other than the carrier) acquires, physical possession of the products in your order. If you are a customer based in the European Union or the European Economic Area and have made a purchase via the Sales Channels, this is considered to be your statutory right to withdraw from the contract. To meet the withdrawal deadline, it is sufficient for you to withdraw before the withdrawal period has expired.   

To cancel the contract and return your product(s), you can contact our Client Relation Centre and follow the instructions that will be given to you, or send us in writing an unequivocal statement such as a letter or e-mail to: Panerai, Client Relations Centre, RLG Europe BV, PO Box 2967, NL-1000 CZ Amsterdam, or concierge.europe@panerai.com, you may cancel using the Model Cancellation Form, but it is not obligatory.

(b)   Return Process

Products that have been purchased through the Sales Channels may only be returned to our Panerai e-boutique distribution center at the address of our Returns Department, as provided in our FAQs section.

Products that have not been purchased through the Sales Channels may NOT be returned to our Panerai e-boutique distribution center.

To return a product to our e-boutique distribution center, you must follow the steps mentioned below: 

(i)               Call the Client Relations Center

(ii)              You may either choose (a) our pick up service and agree on a pick-up date with our logistics partner or (b) a parcel drop off at any Swiss Post Office within the return period. You may be asked at this stage to provide information about the product for us to make a first assessment of the condition of this product;

(iii)             In the event you chose parcel drop off at the Swiss Post Office, the Client Relations Center will send you a prepaid return label by e-mail; if you chose our return pick up service, our logistic provider will bring the prepaid return label at the time of pick-up.

(iv)             You must include in the delivery package, the product, along with all its accessories, any free items you received as part of your order, the Service Guide, the Warranty Card and all other documents, in their original box;

(v)              Please seal the delivery package, if applicable, print the prepaid return label and affix it to the parcel; and, depending on the option you chose according to lit (ii) above:

(vi)             On the agreed date, our logistics partner will pick-up the sealed delivery package and give you a return tracking number which you should keep until the order refund confirmation is received or you may drop off the parcel at any Swiss Post Office within the return period, in which case you will be given a receipt with return tracking number which should be kept until order refund confirmation is received.

You must keep a proof of return shipment, and we accept no liability in the event that such proof cannot be produced. Only merchandise received by our Panerai e-boutique distribution center will be eligible for a refund or exchange.

(c)    Condition of Returned Products

We will verify that the returned product satisfies the conditions of the Returns and Exchanges Policy and, if so, then proceed with the applicable refund or exchange.

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. For example, timepiece bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. We reserve our right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.

If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (QC) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be sent back to you. If the returned product satisfies QC, we will proceed with the applicable refund or exchange. 

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(d)   Products you cannot return or exchange

Orders for products that have been personalized in any way or otherwise made for you with bespoke specifications cannot be cancelled and such products cannot be returned to us for exchange or refund.

(e)    Refunds

You may return a product purchased through the Sales Channels for refund, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above.

Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Client Relations Center to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of a defective product by us, initial shipping charges will not be refunded.

(f)     Exchanges

You may return a product purchased through the Sales Channels for exchange with another Panerai product, provided that the return complies with these Conditions of Sale in particular with (a) Right to Cancel and (b) Return Process above.

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference.

If a product is returned for exchange with a more expensive product, you will have to pay the price difference. 

Manufacturer’s guarantee and your legal consumer rights

We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

Selected products are covered by the applicable Panerai Guarantee. If you wish to repair a product covered by the applicable Panerai Guarantee, please refer to the applicable Panerai Guarantee, and call our Client Relations Center for more information.

In your capacity as consumer, you may have legal rights under the applicable law of governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale or the applicable Panerai Guarantee.

Complimentary Services

The following complimentary services will be proposed, free of charge, by the Sales Channels:

(a)  Gift Wrap and Packaging

All orders will be shipped with the Panerai box gift wrapped in Panerai special packaging, together with a Panerai shopping bag (where applicable).

Orders for personalized Panerai products cannot be cancelled and personalized Panerai products cannot be returned to Panerai for exchange or refund.

 (b)  Strap Exchange / Adjustment

A Panerai watch strap is delivered in a standard size. For certain products, the strap size can be delivered smaller or larger. If available, please specify your requirements on the Platforms or by calling the Client Relations Center. Panerai watch strap adjustment is also available on certain watch models. If you request a watch bracelet adjustment, the removed links will be returned to you and included in the delivery package.

(c)  Gift Note

You may be able to personalize your order by adding a personalized note that will be printed by Panerai on a gift card to be included in your order package. Panerai reserves the right to reject gift card notes it deems offensive or inappropriate to be sent on Panerai-logo stationery.

Repairs

For any repair inquiries relating to a product ordered through the Sales Channels, please refer to our FAQs section or contact our Client Relations Center.

Product descriptions

We try to ensure that the information, including product descriptions, dimensions, and colours, provided on the Platforms, in advertisements or catalogues or as provided by the Client Relations Center is accurate and complete. However, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. 

Limitation of liability

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Panerai Guarantee.

General provisions

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Panerai Guarantee.

Applicable law and jurisdiction

These Conditions of Sale shall be governed by and construed in accordance with the laws of Switzerland without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in relation to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, shall be adjudicated or arbitrated in accordance with the Conditions of Sale.  Where the laws of Switzerland are different to the mandatory consumer laws in your own country, we will afford you with similar protection.

You may bring proceedings against us either in the courts of Fribourg or in the country where you are domiciled. We may also bring proceedings against you in the courts of the country where you are domiciled.

Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

If you are a consumer resident in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution entity. 본 판매 약관은 수시로 개정될 수 있으므로, 귀하는 개정된 사항을 확인할 수 있도록 본 판매 약관을 정기적으로 확인해주시기 바랍니다. 본 판매 약관의 최신본은 플랫폼에서 언제든 확인 가능합니다. 개정된 판매 약관은 게시된 날 즉시 효력이 발생하며, 해당 일부터 이루어지는 모든 제품이나 서비스 주문에 적용됩니다. 귀하가 주문을 한 이후 본 판매 약관이 변경될 경우에는 법률에 따른 예외를 제외하고 귀하의 변경 전 주문이나 당사와의 관계에 영향을 미치지 않습니다.

구매 자격

(a) 계약을 체결할 수 있는 법정 연령(한국의 경우 만19세) 이상이고, (b) 계약을 체결할 수 있는 법적 행위능력이 있고, (c) 판매 채널에 명시된 배송 가능 국가의 배송 주소를 사용하는 개인만이 판매 채널을 통하여 주문할 수 있습니다(법인은 주문 불가). 귀하가 미성년자이거나 계약을 체결할 수 있는 행위능력이 없는 경우, 귀하를 대신하여 부모나 후견인이 주문하도록 하여야 하며 부모나 후견인이 본 판매 약관에 동의하여야 합니다.  

판매 채널을 통해 주문함으로써, 귀하는 주문된 상품 또는 서비스를 자신 또는 타인의 개인적 사용을 목적으로 구매한 최종소비자이며, 당사 제품을 제공, 판매 및 기타의 방법으로 유통시키지 않을 것이고, 상업적 목적으로 당사 제품이나 서비스를 구매하는 것이 아님을 진술 및 보증합니다.

제품 재고 및 수량

판매 채널을 통한 모든 주문은 재고 현황 및 당사의 주문 승낙을 조건으로 합니다. 파네라이는 플랫폼이나 컨택 센터를 통하여 제공되는 상품 구성 변경 권한을 보유하며, 사전 통지 없이 귀하가 한번에 구매할 수 있는 파네라이 제품 수량을 수시로 제한할 수 있습니다. 또한, 파네라이는 사전 통지 없이 언제든지 특정 제품에 대해 일정 수량을 초과하는 주문을 거절할 수 있습니다. 현재 플랫폼이나 컨택 센터를 통하여 주문 시 한 번에 최대 다섯 개의 제품을 주문할 수 있습니다. “장바구니에 추가” 표시가 있는 제품만 플랫폼을 통하여 구매 가능한 점을 참고하시기 바랍니다. 귀하는 파네라이 컨택센터(1670-1936 ) 전화연결을 통해 파네라이 앰배서더(PANERAI Ambassador)로부터 제품 재고여부를 확인 받을 수 있고, 구매 절차 관련 지원을 받을 수 있습니다.  

귀하는 컨택 센터 및 플랫폼상 제품 페이지에서 해당 채널 통해 현재 구매 가능한 제품 관련 정보를 확인하실 수 있습니다.

계정 등록 및 비회원 주문(Guest Checkout)

플랫폼을 통해 주문하기 위해서는 귀하 또는 (귀하를 대신하여) 파네라이 앰배서더가 플랫폼에 온라인부띠끄 계정을 개설 및 등록하거나, “비회원 주문” 선택을 통해 온라인 부띠끄 계정 개설 없이 비회원으로서 주문할 수 있습니다. 플랫폼 계정 개설을 위하여, 귀하는 귀하의 법적 성명, 전화번호 및 이메일 주소 등 귀하의 유효한 최신의 개인정보를 제공하여야 하고, 귀하가 성년임이 확인되어야 합니다.

귀하가 “비회원 주문”을 선택할 경우, 귀하는 주문 및 배송 확인서 수령 시점에 파네라이 온라인 부띠끄 계정을 생성 할 수 있습니다. 참고로, 이 경우 계정 등록 이전 구매 정보는 귀하의 파네라이 온라인 부띠끄 계정에 반영되지 않습니다.

귀하 또는 파네라이 앰배서더를 통한 플랫폼 계정 등록이 완료되면 이메일을 통해비밀번호 재설정 링크가 제공되고, 이를 통해 귀하는 플랫폼의 본인 계정에 접속하여 영구 계정 로그인 및 비밀번호를 설정할 수 있습니다. 온라인 부띠끄 계정 로그인 및 비밀번호의 비밀 및 보안 유지 책임은 귀하에게 있습니다. 파네라이는 제3자의 귀하 비밀번호 및 계정 로그인 접속, 사용으로 인한 귀하 계정 오용에 대하여 어떠한 책임도 부담하지 않습니다.

귀하의 개인정보 이용 관련 상세사항은 당사 Personal Information Management Policy을 참조하여 주시기 바랍니다. 플랫폼에서 “비회원 주문”을 선택하면 귀하의 온라인 계정은 개설되지 않고, 당사는 귀하의 개인정보를 오로지 귀하의 주문 처리 목적으로만 사용합니다.

플랫폼을 통한 주문 시 배송 주소, 보내는이 주소 및 결제 정보를 포함한 기타 개인정보의 제공이 요구됩니다. 파네라이나 제3제공자는 이러한 과정에서 보안 목적상 추가적인 정보를 수집할 수 있습니다.

귀하는 컨택 센터나 플랫폼에 제공된 개인정보가 모든 면에서 진실되고, 유효하며, 완전한 최신의 정보임을 진술 및 보증합니다. 또한 귀하는 귀하가 제공된 배송지(선물이 아닌 한) 및 보내는이 정보의 당사자임을 확인합니다.

귀하가 컨택 센터나 플랫폼에 제공된 정보가 변경되는 경우, 귀하의 계정에 접속하여 플랫폼상 정보를 직접 변경하고 컨택 센터(1670-1936), 이메일(concierge.kr@panerai.com)이나 당사 Personal Information Management Policy.

에 기재된 연락처를 통하여 알려주시기 바랍니다.

개인맞춤서비스

일정 제품에 대해서는 개인맞춤서비스(압인, 각인) 또는 기타 서비스 제공이 가능합니다. 귀하 제품의 개인맞춤화를 원할 경우 판매 채널의 요청에 따라 상세사항을 제공하여 주시기 바랍니다.

당사는 불쾌감을 유발하거나 위법 또는 당사 방침에 반하는 문구에 대해서는 개인맞춤제품 또는 메시지 카드 주문 승낙을 보류 또는 거절할 권리를 보유합니다. 제품 각인 문구의 정확성에 대해서는 이를 제공한 귀하가 책임을 부담합니다.

또한, 개인 맞춤화된 제품 주문은 취소가 불가능하고, 어떠한 방식으로든 개인 맞춤화되거나 귀하의 요청에 맞추어진 제품은 본 판매 약관에 따른 교환 또는 반품이 불가합니다. 단, 귀하가 소비자로서 보유하는 권리에 대해서는 영향을 미치지 않습니다(추가 정보는 이하 Manufacturer’s guarantee and your legal consumer rights를 참조하여 주시기 바랍니다).

주문 절차

플랫폼을 통한 주문 절차는 다음과 같은 사항을 포함합니다:

·            장바구니 추가: 귀하는 제품을 선택하여 장바구니에 추가할 수 있습니다. 이후 다른 제품 쇼핑을 계속하여 장바구니에 추가할 수 있습니다(재고 및 수량 제한 적용). 장바구니에 물건을 추가하였다고 해서 구매가 가능한 것으로 보장되는 것은 아니며, 구매는 주문 및 배송 확인을 서면으로 수령한 시점에 확정됩니다.

·            비회원/MY PANERAI 계정 주문: 주문할 준비가 되었으면 비회원으로서 또는 등록된 계정을 통하여 “주문(Checkout)” 진행이 가능합니다. 주문 과정에서 장바구니 일부 품목을 선택하여 제외할 수 있습니다.

·            배송, 확인 및 결제: 주문 과정에서 귀하의 주문 내역과 개인정보를 추가 및 검토할 수 있습니다(이메일, 배송 주소, 발송인 주소 및 결제 정보 포함). 주문 완료 이전 주문 요약 페이지 내역을 상세히 검토하여 확인하시기 바랍니다.

·            주문 완료: 마지막으로 동의 사항을 체크하고 주문을 완료합니다.

컨택센터를 통하여 주문하는 경우 파네라이 앰배서더가 상기 절차를 안내하고 귀하의 주문 내역을 구두로 확인할 것입니다.

당사는 합리적 사유에 근거하여 단독 재량으로 언제든지 주문을 거절, 취소 및 해지할 권한을 보유합니다. 예를 들어, 귀하의 과거 주문의 결제 관련 분쟁이 계속 중인 경우 또는 귀하가 (i) 사기 또는 암시장 활동, (ii) 본 판매 약관 위반 행위에 관여한 것으로 의심되는 경우, 당사는 귀하의 주문을 거절, 해지 또는 취소할 수 있습니다.

가격, 세금 및 배송료

플랫폼 제품 페이지에 표시되거나 또는 컨택 센터에서 제공된 가격은 모두 부가세를 포함하나, 달리 명시되지 않는 한, 배송비(Shipping Cost) 및 기타 세금은 제외된 것입니다.

배송비(Shipping Cost)는 별도로 부과되지 않습니다.

당사는 사전 통지 없이 언제든지 가격 및 배송비를 변경할 권한을 보유합니다.

당사는 제품 가격 및 배송비 정보의 정확성을 시스템에 입력되거나 컨택 센터를 통해 제공될 때 최대한 주의를 기울여 확인하고 있습니다. 다만, 당사의 이와 같은 노력에도 불구하고 판매 채널을 통해 제공되는 제품 가격이나 배송비 표기 오류 가능성을 배제할 수 없습니다. 귀하가 주문한 제품 가격이나 배송비 표기에 오류가 있는 경우 신속하게 연락을 취하도록 하겠습니다. 귀하가 주문 절차상 제공한 연락처를 통한 연락이 불가능한 경우, 당사는 주문을 취소하고 이를 서면으로 고지합니다. 가격이나 배송비 표기 오류가 있는 제품 주문을 당사의 실수로 승인 및 처리한 경우, 당사는 제품 공급을 취소하고 당사가 지불한 금액을 환불 조치할 수 있습니다.  

결제

당사는 판매 채널을 통한 주문과정에서 설정된 결제 수단을 수락합니다. 결제 방법에 따라 특정 형식에 따른 신분 확인을 포함한 추가 정보 제공이 요구될 수 있습니다.

플랫폼을 통한 주문 시, 귀하는 적절한 양식에 결제 정보를 입력하여야 합니다. 유선으로 주문 시에는 컨택 센터를 통해 귀하의 결제 정보를 제공하여야 합니다. 모든 결제 카드 소유자에 대해서는 카드 발행사의 유효 여부 확인 및 승인이 필요합니다. 귀하의 카드 발행사가 당사에 대한 지급 승인을 거절하는 경우, 귀하는 직접 카드 발행사에 연락하여 문제를 해결하여야 합니다.

기타 결제 수단에 대해서도 결제 시스템 제공자의 유효 여부 확인 및 승인이 요구될 수 있습니다. 귀하는 당사로 하여금 필요에 따른 보안 확인을 할 권한 및 수시로 제3자에게 또는 제3자로부터 귀하 관련 정보를(업데이트 정보 포함) 전송 및 수령할 수 있는 권한을 명시적으로 허여합니다. 이와 같은 정보에는 결제 카드 정보, 신원 확인을 위한 정보, 카드 확인 및 최초 결제 승인 및 개별 구매 승인을 위한 정보가 포함되나 이에 한정되지 않습니다. 

주문 시 당사 주문 페이지를 통해 결제가 처리되며, 귀하는 제3자 결제대행사업체(NHN KCP) 모듈 페이지로 연결되어 결제를 완료하게 됩니다. 당사는 신용카드, 계좌이체 및Payco 간편결제의 세 가지 옵션을 제공합니다.

귀하가 신용카드를 결제수단으로 선택 하는 경우, 귀하는 당사와 계약된 신용카드 회사 및 할부 또는 일시 지급을 선택하고, 기타 요구되는 확인 절차를 처리하여야 합니다. 할부 지급을 선택할 경우, 귀하는 대금 완납 이전 시점에 제품을 수령하게 됩니다. 일시 지급 선택 시 귀하는 신용카드 회사로부터 지급 확인이 이루어진 이후 제품을 수령하게 됩니다. 일시 또는 할부 지급의 경우 지급은 적절한 승인 절차를 거쳐 이루어집니다. 직불 카드 결제 선택 시, 적절한 승인 절차를 거쳐 대금 결제가 완료된 이후 귀하는 제품을 수령하게 됩니다.

전화로 주문하는 경우, 컨택 센터는 주문 완료 이후 귀하에게 지급 결제 요청 이메일을 보냅니다. 해당 링크를 통하여 귀하는 직접 결제 방법을 선택하여 결제를 진행하게 됩니다.

주문 확인

귀하의 선택 후 판매 채널을 통한 주문이 이루어지면 주문 확인서(Acknowledgement of Order)가 서면으로 (주문 번호와 함께 주문 내역을 확인하는 내용의 이메일 또는 기타 수단) 제공됩니다. 향후 주문 관련 문의를 위하여 주문 번호를 저장하여 두시기 바랍니다. 단, 주문 확인서가 귀하의 주문에 대한 승낙을 의미하는 것은 아닙니다. 당사는 주문을 확인하기 위하여 통상적 신용, 사기, 보안 및 관련 법적 사항을 검토하여 확인한 이후 귀하의 주문을 처리합니다. 주문 확인서를 수령한 이후 해당 확인서가 귀하의 주문 내역을 정확히 반영하는지 여부를 검토 및 확인할 책임은 귀하에게 있습니다. 주문 확인서에 대한 질문, 유의사항이 있거나 주문 확인서가 귀하의 주문을 정확히 반영하지 않는 경우 신속하게 컨택센터로 연락 주시기 바랍니다.

본 판매 약관은 당사가 귀하의 주문을 확인할 때 제공됩니다.

배송 정책

당사는 우체국 택배 및 Valex가 인정하는 주소로 배송합니다.

귀하가 여러 제품을 주문하는 경우, 당사는 주문 대상 제품이 모두 준비된 이후에만 배송을 시작합니다(달리 고지되지 않는 한, 향수를 제외하고 일부 배송은 하지 않습니다).

주문 및 배송 확인

귀하의 주문에 대한 배송 시 당사는 서면으로 주문 및 배송 확인서를 제공합니다(이메일 또는 기타 방법). 본 주문 및 배송 확인서는 귀하의 주문에 대한 당사의 승낙이자 기속력 있는 매매계약의 존재를 의미합니다. 

배송

당사는 주문 및 배송 확인 일자로부터 삼십(30)일 이내에 배송이 이루어질 수 있도록 합리적 노력을 다 할 것입니다. 다만, 귀하 요청에 따른 개인 맞춤화 또는 제조가 요구되는 제품이나 서비스와 같이 당사가 추가 기한이 필요함을 설명한 경우는 제외됩니다.

당사의 통제 범위를 벗어난 사유로 인하여 제품 배송이 지연되는 경우, 당사는 귀하에게 가능한 신속하게 통지하고 그로 인한 지연을 최소화하기 위하여 합리적 노력을 다할 것입니다. 당사가 주문 및 배송 확인 일자로부터 삼십(30)일 또는 달리 명시한 기한 내에 배송하지 못 하는 경우, 귀하는 컨택센터에 연락하여 해당 주문을 취소하고 수령하지 못한 제품에 대해 귀하가 지불한 금액을 환불 받을 수 있습니다.

어떠한 경우에도 당사의 배송 관련 불이행에 대한 귀하의 유일한 구제 수단은 해당 주문을 취소할 권리 및 수령하지 못한 제품에 대해 귀하가 지급한 금액의 반환으로 제한됩니다.

귀하가 배송 일정을 예상할 경우, 신용 승인, 주소 확인, 보안 확인 및 주문 처리 시간을 고려하여 주시기 바랍니다. 또한 배송은 항상 결제 완료를 조건으로 함을 참고하여 주시기 바랍니다.

각 제품 배송 확인을 위하여 당사는 귀하 또는 (귀하가 달리 지정하지 않는 한) 지정된 배송지의 사람에게 수기 또는 전자 서명을 요청할 것이며, 해당 시점에 구매 제품의 위험 및 책임이 이전됩니다. 귀하가 배송 목적상 귀하가 아닌 수령인을 지정한 경우 (가령, 선물의 경우), 해당 수령인(또는 배송지의 사람)의 서명으로 배송 및 파네라이의 매매계약 이행의 완료가 증명되며 귀하에게 제품이 배송된 것과 동일하게 해당 수령인에게 책임이 이전됨을 인지하고 수락합니다. 특정 제품군의 경우, 당사는 포장 라벨에 수령인으로 기재된 사람에게만 배송하고 배송 시 신분증 확인을 요청할 수 있습니다. 관련된 추가적인 사항은 당사 컨택 센터로 문의 주시기 바랍니다.

환불 및 교환

(a)   취소 권한

귀하는 당사의 서면 주문 확인으로 체결된 계약을 (i) 주문 및 배송 확인서를 받은 날 또는 (ii) 귀하 또는 귀하가 지정한 사람(배송업체 제외)이 주문 제품 점유를 취득한 날 중 이후에 도래하는 날짜로부터 칠(7)일 이내에 임의로 취소할 수 있습니다.

귀하는 [here]의 온라인 양식을 통하여 계약 취소 및 온라인 구매 제품 반환을 할 수 있습니다. 컨택센터를 통한 구매 제품 반환의 경우 해당 센터에 연락하시기 바랍니다. 

(b)   반품 절차

판매 채널을 통하여 구매된 제품은 본 판매 약관에 따라 컨택 센터가 제공한 반품 부서(Returns Department) 주소의 파네라이 온라인 부띠끄(e-boutique) 물류센터로만 반품 가능합니다.

판매 채널을 통해 구매되지 않은 제품은 당사 온라인 부띠끄(e-boutique) 물류센터로 반품할 수 없습니다.

귀하는 반품 배송 증빙을 보관하여야 하며, 해당 증빙이 제공되지 않는 경우 당사는 이에 관한 어떠한 책임도 부담하지 않습니다. 당사 파네라이 온라인 부띠끄 물류센터로 수령된 제품에 대해서만 환불 또는 교환이 가능합니다.

(c)   반품 제품의 상태

당사는 반품된 제품이 환불 및 교환 방침의 조건을 충족하는지 여부를 확인한 이후 해당 환불이나 교환을 처리합니다.

당사 제품은 새 것의 사용되지 않은 완전한 상태로, (해당되는 경우) 관련 부속품 및 서류를 포함하여 기본 파네라이 상자 및 배송 포장 등 모든 포장재, 시큐리티 태그 및 스티커가 부착된 채로 반품되어야 합니다. 가령, 귀하 요청에 따라 조정된 시계 팔찌는 원 배송 포장에 있던 링크 개수 그대로 반환되어야 합니다. 당사는 제품이 사용된 흔적이 있는 경우, 제품 부착 시큐리티 태그가 제거되거나 여하한 방법으로 제품이 사용되거나 또는 원 상태로부터 여하한 방식으로 변경된 경우, 반품을 거절 또는 환불, 교환 금액을 인하할 수 있습니다. 

주문의 일부로 무료 상품을 받은 경우 이러한 상품도 함께 반품되어야 합니다.  

모든 반품에 대해서는 위와 같은 조건 충족 여부를 확인하기 위해 당사의 엄격한 품질 검사(QC)가 이루어집니다. 제품이 QC기준에 미달할 경우, 당사는 반품 수령을 거절하고 해당 제품은 귀하에게 반송될 것입니다. 제품이 QC기준을 충족할 경우 당사는 환불이나 교환 절차를 진행합니다.

본 판매 약관을 준수하지 못 할 경우 당사는 반품 제품 수령을 거절하고 귀하의 비용 부담으로 제품을 반송할 권리를 보유합니다.  

(d)   반품 또는 교환 불가 제품

여하한 방법으로 개인 맞춤화되거나 맞춤 제작된 제품 주문은 취소가 불가능하며, 이러한 제품은 교환이나 환불을 위하여 반품될 수 없습니다. 이에는 압인 또는 각인된 제품들이 포함되나 이에 한정되지 않습니다.

잉크가 채워진 필기구 및 개봉된 병이나 리필 역시 당사에 반품 불가합니다.

개봉 또는 원 봉인이 제거된 화장품은 반품 불가합니다. 화장품은 미사용, 미개봉된 상태로 원 봉인을 유지하여 반품되지 않는 한, 당사는 반품을 거절할 수 있습니다. 단, 향수와 에어로졸 판매는 최종적이며 반품 불가능합니다.

(e)   환불

귀하는 판매 채널을 통해 구매한 제품의 환불을 받기 위하여 반품할 수 있으나, 해당 반품은 특히 상기 (a) 취소 권한 및 (b) 반품 절차를 포함하는 본 판매 약관을 준수하여야 합니다.

매수인만이 매매대금의 환불을 받을 수 있으며 어떠한 경우에도 제품을 선물로 받은 사람(“선물 수령인”)은 환불을 받을 수 없습니다. 귀하가 선물 수령인으로서 제품을 반품하고자 하는 경우, 컨택 센터에 연락하여 가능한 옵션을 상의하시기 바랍니다.

반품이 본 판매 약관을 준수하면 당사는 해당 제품이 파네라이 온라인 부띠끄 물류센터로 수령된 날로부터 삼(3) 영업일 이내에 매수인의 애초 결제 방법과 동일한 방법으로 매매대금을 매수인에게 환불 처리하기 위하여 상업적으로 합리적인 노력을 다할 것입니다.

(f)    교환

(g)   귀하는 판매 채널을 통해 구매한 제품을 1회에 한해 사이즈 교환으로 반품할 수 있으며, 해당 반품은 특히 상기 (a) 취소 권한 및 (b) 반품 절차를 포함하는 본 판매 약관을 준수하여야 합니다. 귀하는 교환을 요청할 수 있고, 이와 달리 당사는 귀하의 기존 주문 환불 및 새로운 주문 처리로 진행할 수 있습니다. 어떠한 경우에도 반품된 제품 판매는 취소되며 주문 제품에 대한 새로운 주문이 이루어져야 합니다. [PP(1] [PP(2]

You may return a product purchased through the Sales Channels only for a one-time exchange with a different size of the same PANERAI product and price, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above.  For any subsequent exchanges or other exchanges expressly permitted under these Conditions of Sale, we will refund your original order and process a new order. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

 

제조업자 보증 및 소비자 법적 권리

당사는 모든 제품이 당사 품질 기준을 엄격하게 준수하고 당사 기술적 기준 및 미적 기준에 부합하도록 최선을 다하고 있습니다.

일부 제품은 파네라이 보증(PANERAI Guarantee)으로 보장됩니다. 귀하가 파네라이 보증으로 보장되는 제품의 수리를 원하는 경우 해당 제품에 적용되는 파네라이 보증의 내용을 참고하여 주시고, 추가적인 사항은 당사 컨택센터로 연락 주시기 바랍니다.

귀하는 소비자로서 소비재 판매를 규율하는 법률에 따른 법적 권리를 보유합니다. 이러한 법적 권리는 본 판매 약관이나 해당 파네라이 보증으로 인하여 영향 받지 않습니다. 한국에서 소비자는, 광고나 매매 계약에 기재된 상세사항과 수령한 제품에 차이가 있을 경우 (i) 제품을 수령한 날로부터 3개월 이내 또는 (ii) 하자 또는 불일치를 알게 된 날로부터 30일 이내에 주문을 취소할 수 있습니다.

무료 서비스

이하 서비스는 판매 채널의 부담으로 귀하에게 무상 제공됩니다:

(a) 선물 포장

모든 주문 상품은 파네라이 쇼핑백(해당되는 경우)과 함께 파네라이 특별 포장된 파네라이 선물 상자와 함께 배송됩니다.

(b)  각인 / 압인

특정 제품에 대해서는 각인 및 압인 서비스가 가능하고 컨택 센터를 통한 주문 판매에 대해서만 제공됩니다.

귀하의 파네라이 제품 각인이나 압인을 원하시면 직접 온라인으로 주문 가능합니다. 전화 주문 시 파네라이 제품 각인이나 압인을 원하는 경우 컨택 센터에 관련 정보를 제공하여 주시기 바랍니다.

개인 맞춤화된 파네라이 제품 주문은 취소 불가능하며, 개인 맞춤화된 제품은 교환 또는 환불을 위하여 반품될 수 없습니다.

파네라이 시계 줄은 표준 규격으로 제공됩니다.  귀하는 컨택 센터에 연락하여 줄 규격 변경을 요청할 수 있습니다. 특정 시계 모델의 경우 시계 줄 조정도 가능합니다. 시계 팔찌 조정을 요청하는 경우, 제거된 고리는 배송 포장에 포함되어 귀하에게 반환됩니다.

당사는 제품 설명, 치수, 색상을 포함하여 플랫폼, 광고나 카탈로그 또는 컨택센터를 통하여 제공되는 정보의 정확성과 완전성을 갖추기 위하여 노력하고 있습니다. 그러나 당사는 해당 정보의 정확성, 신뢰성 및 완전성에 대하여 명시적으로나 묵시적으로 어떠한 보증을 제공하지 않습니다.

책임 제한

관련 법률이 허용하는 최대한의 범위 내에서, 당사는 법률에 따라 명시 또는 묵시적으로 또는 과거 거래 관행, 용도나 실무에 따라 제품 및 판매 채널 관련 여하한 약관 및 보증을 부인 및 배제합니다.

본 판매 약관은 적용되는 법률에 따라 제한 또는 배제될 수 없는 당사 책임을 제한 또는 배제하지 않습니다. 이러한 전제 하에 당사가 주문 관련하여 본 판매 약관에 따라 귀하에게 부담하는 총 책임은 계약, 불법행위 (과실 포함)나 기타 근거를 불문하고 어떠한 경우에도 귀하가 주문한 제품 가격의 일백 퍼센트(100%)를 초과하지 않고, 이는 당사에게 그러한 손해 가능성이 알려진 경우에도 마찬가지입니다.

본 판매 약관의 일부 또는 조항이 위법, 무효 또는 집행 불가능한 것으로 판단되는 경우, 해당 부분이나 조항은 본 판매 약관의 일부를 구성하지 않는 것으로 간주되나, 본 판매 약관의 다른 조항의 적법성, 효력 또는 집행 가능성은 법률에 따라 달리 요구되지 않는 한 여전히 유효합니다.

본 판매 약관 (및 참조로 포함된 기타 약관)은 제품 또는 서비스 주문 관련하여 귀하와 당사간 완전한 합의를 구성하며, 구두 또는 서면 여부를 불문하고, 관련 사전 계약, 계약 초안, 약정, 약속 또는 성격 불문 여하한 담보 계약을 대체하며, 그에 우선합니다.

당사는 당사의 합리적 통제 범위를 벗어난 사유로 인한 본 판매 약관상 여하한 의무 이행이나 준수 불이행 또는 지연에 대하여 책임을 부담하지 않습니다.

본 판매 약관 조항 위반에 대한 당사의 어떠한 포기나 면제는 기타 또는 이후 위반에 대한 포기나 면제로 해석되지 않습니다.

적용 법률 및 관할

본 판매 약관은 국제사법 규정의 적용을 받지 않고, 한국법을 준거법으로 하며 이에 따라 해석됩니다. 본 판매 약관의 유효, 무효, 위반 또는 해지를 포함하여 본 판매 약관 관련 발생하는 여하한 분쟁, 다툼이나 청구는 본 판매 약관에 따라 판단 및 중재됩니다. 한국법과 귀하 국가의 강행규정인 소비자 법률의 내용이 상이한 경우 당사는 귀하에게 귀하 국가의 소비자 법률과 유사한 수준의 보호를 제공합니다. 

귀하는 한국 내 법원 또는 귀하가 거주하는 국가의 법원에서 당사에 대한 소송을 제기할 수 있습니다. 당사 역시 귀하가 거주하는 국가의 법원에서 귀하에 대한 여하한 절차를 개시할 수도 있습니다. 

법원 절차 개시에 대한 제한이 있는 것은 아니나, 귀하와 파네라이는 제품, 본 판매 약관이나 그 위반 관련하여 발생하는 여하한 분쟁이나 불이행에 대하여 먼저 첫 삼십(30)일 기간 동안 원만하게 해결하기 위한 합리적 노력을 할 것입니다.

The following terms and conditions and any other related rules that are adopted by Panerai and made available as provided herein (collectively, the “Conditions of Sale”) shall apply to all sales of products that you (the “Customer” or “you”) may order from Richemont Asia Pacific Limited, 6/F Jardine House, 1 Connaught Place, Central, Hong Kong (“Panerai, or referred to herein as us, ouror we”) on the Internet via the Panerai Website, identified by (if applicable) the domain name www.panerai.com (the “Website”) or by phone (+852 8200 3033) via the customer contact center of Panerai (the “Client Relations Center”). For the avoidance of doubt, the E-boutique Website will be available at a later stage.

 

These Conditions of Sale are applicable to any order placed through the Client Relations Center or the Website. If you refuse to accept these Conditions of Sale, you will not be able to order any Panerai products from the Website or the Client Relations Center. Sales concluded through Panerai authorized retailers or physical points of sale are not subject to these Conditions of Sale.

 

Your use of the Website is governed by our Terms of Use. In addition, our information collection practices, such as the types of information we collect regarding visitors to the Website, or callers to the Client Relations Center, and the ways in which we may use and protect that information, are further set out in our Privacy Policy. Persons wishing to use the Client Relations Center or the Website will also be deemed, by virtue of such use, to have agreed to be bound by the Terms of Use and Privacy Policy, which are incorporated into these Conditions of Sale by reference (and are available here Terms of Use, Privacy Policy).

 

The Conditions of Sale, Terms of Use and Privacy Policy may be updated at any time by us without notice.

PURCHASING ELIGIBILITY

Only individuals (and not legal entities) who (a) have reached the age of eighteen (18), (b) have legal capacity to enter into contracts and (c) have a shipping address in the location or locations listed in Clause 14 may order products through the Client Relations Center or on the Website. If you are under the age of eighteen (18) or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and thereby assent to these Conditions of Sale. By placing an order through the Client Relations Center or on the Website, you represent and warrant that you are a bona fide end-user customer and will not deliver, sell or otherwise distribute Panerai products or purchase Panerai products for commercial purposes or any other commercial benefit.

PRODUCT AVAILABILITY; QUANTITY

All orders placed through on the Website are subject to availability and acceptance by Panerai. Quantity limits may apply in relation to certain products. Panerai further reserves the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

ACCOUNT REGISTRATION; GUEST CHECKOUT

In order to place an order, you or the Panerai Ambassador (on your behalf) may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to “I have read and I accept the Conditions”. Then, place your order.

 

Notwithstanding anything to the contrary provided for herein, Panerai reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Panerai may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if Panerai suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Conditions of Sale or the policies incorporated herein by reference.

PRICES, TAX AND SHIPPING COSTS

All prices shown on the product pages of the Website or quoted by the Client Relations Center are in Hong Kong Dollars.

 

Panerai reserves the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the Website or quoted by the Client Relations Center, at the time Panerai provides you with a Confirmation of Order will be honored by Panerai.

 

Actual shipping costs and applicable taxes, if any, will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options.

Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. If the resulting change is an increase in the sales tax you are charged, we will contact you and ask that you reconfirm your purchase.

PAYMENT

We accept the methods of payment offered on the Website or through the Client Relations Center.

 

When ordering on the Website, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your credit/debit card number and your three or four digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID).

 

All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Panerai, you will need to contact your card issuer directly to solve this problem.

 

In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is shipped to the shipping address you have provided to Panerai, at which point in time you will be sent a Confirmation of Order and your credit card will be charged the applicable purchase price. By submitting an offer to purchase Panerai products on the Website or through the Client Relations Center, you expressly authorize Panerai to perform security checks, where Panerai deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

 

Where we offer PayPal/Alipay/WeChat Pay as a payment method, the full amount of your purchase may be taken immediately following the placement of your order. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer.

 

Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Panerai will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order.

 

These Conditions of Sale will be provided to you with the Acknowledgement of Order. Please carefully review these Conditions of Sale upon receipt.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them.

 

The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

 

Panerai reserves the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to Panerai policies.

 

Personalized products cannot be returned to Panerai for refund or exchange.

SHIPPING POLICY

We only accept orders for delivery to addresses in Hong Kong S.A.R., China. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels.

 

Boutique pick-up may be offered, free of charge, to certain locations. Please refer to the Website or call the Client Relations Center for more information. Panerai will inform you by email or by telephone when the product is ready for pick-up at the boutique.

 

If you order several products, Panerai will ship the order only once all products are available (no partial shipments).

 

We will use commercially reasonable endeavours to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order.

 

When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at any time later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the location or locations listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.



 

17.1. Return Period

Panerai allows you to return in the location or locations listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.



 

17.2. Return Process

Products that have been purchased on the Website or through the Client Relations Center may only be returned to the Panerai e-boutique distribution center at the address of the Panerai Returns Department, as provided by the Panerai Client Relations Center, or in selected Panerai retail boutiques, in accordance with these Conditions of Sale.

 

Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center.

 

To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

      i.         Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii.         Please, fill out the required information on the Return Form enclosed and sign it,

    iii.         You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

    iv.         Please, seal the delivery package,

     v.         On the agreed date, our logistics partner will bring you a pre-paid airway bill and pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.

 

To return a product to a Panerai retail boutique, please call the Client Relations Center (telephone number indicated on the Website) first to confirm the appointment with your selected Panerai retail boutique. You may be asked to provide photos of the products for us to make a first assessment of the condition of these products.

 



17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange.

Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way. Personalized products cannot be returned to Panerai for refund or exchange.

 

If you have received free items as part of your order, they must be returned with the products.

 

Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package.

All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange.

Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.

 



17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale.

 

Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund.

 

If the return complies with these Conditions of Sale, Panerai will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.

 

Should a product be returned to a Panerai retail boutique, the individual making the return will only be entitled to receive boutique merchandise credit. No cash or credit card refunds will be issued in respect of a return to a Panerai retail boutique. Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center.

 



17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale.

 

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

 

Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference.

 

Should a product be returned for exchange to a Panerai retail boutique for exchange with a less expensive product, the individual making the return will only be entitled to receive merchandise credit of the price difference.Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center.

 

If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

MANUFACTURER’S GUARANTEE

Panerai is extremely cautious in ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

 

Selected products are covered by the Panerai International Guarantee. If you wish to repair a product covered by the Panerai International Guarantee, please refer to the Panerai International Guarantee, and call our Client Relations Center for more information.

 

If you receive a product that is covered by the Panerai International Guarantee and seems to have defects originally caused by Panerai (originally defective), please return it to Panerai in accordance with the return process above.

LEGAL GUARANTEE

In your capacity as consumer, you may have legal rights under the laws of Hong Kong S.A.R., China governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale.

REPAIRS

For any repair inquiries relating to a product ordered online, please contact our Client Relations Center (telephone number and email address indicated on the Website). 

ACCURACY OF PRICING, PRODUCT DESCRIPTIONS

While Panerai endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Center, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Panerai does not confirm the price of a Panerai product until an Order Confirmation has been issued by Panerai, indicating the existence of a binding sales contract. If a Panerai product’s correct price is higher than the price posted on our Website, then Panerai will either contact the Customer for instructions before shipping the order or, if Panerai cannot obtain your instructions, reject the order and notify you of such rejection. If the order is rejected and you have already paid for the product, you will receive a full refund. 

FINAL PROVISIONS

Information and complaints. In case of any inquiry or complaint please contact our Client Relations Center on the telephone number and email address indicated on the Website.

 

Entire Agreement. The Conditions of Sale, including policies incorporated herein (e.g., Privacy Policy) constitute the entire agreement between you and Panerai regarding your purchase of Panerai products through the Client Relations Center or the Website, and supersede any prior conditions of sale.

 

Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.

GOVERNING LAW

These Conditions of Sale shall be governed by and construed in accordance with the laws of Hong Kong S.A.R., China.

JURISDICTION

The courts of Hong Kong S.A.R., China shall have exclusive jurisdiction over any disputes arising out of or in connection with these Conditions of Sale.

Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

Actual shipping costs and applicable taxes will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

ACKNOWLEDGEMENT OF ORDER

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

 


17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

 


17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

 


17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

For any repair inquiries relating to a product ordered online, please contact our Client Relations Center (telephone number and email address indicated on the Website).

ACCURACY OF PRICING, PRODUCT DESCRIPTIONS

While Panerai endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Center, to the extent permitted by law, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Panerai does not confirm the price of a Panerai product until an Order Confirmation has been issued by Panerai, indicating the existence of a binding sales contract. If a Panerai product’s correct price is higher than the price posted on our Website, then Panerai will either contact the Customer for instructions before shipping the order or, if Panerai cannot obtain your instructions, reject the order and notify you of such rejection. If the order is rejected and you have already paid for the product, you will receive a full refund.

FINAL PROVISIONS Information and complaints

The Conditions of Sale, including policies incorporated herein (e.g., Privacy Policy) constitute the entire agreement between you and Panerai regarding your purchase of Panerai products through the Client Relations Center or the Website, and supersede any prior conditions of sale. Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.

GOVERNING LAW

These Conditions of Sale shall be governed by and construed in accordance with the laws of New South Wales, Australia.

JURISDICTION

The courts of New South Wales, Australia shall have exclusive jurisdiction over any disputes arising out of or in connection with these Conditions of Sale. Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

If you refuse to accept these Conditions of Sale, you will not be able to order any Panerai products from the Website or the Client Relations Center. Sales concluded through Panerai authorized retailers or physical points of sale are not subject to these Conditions of Sale.

PURCHASING ELIGIBILITY

PRODUCT AVAILABILITY; QUANTITY

All orders placed through on the Website are subject to availability and acceptance by Panerai. Quantity limits may apply in relation to certain products. Panerai further reserves the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

ACCOUNT REGISTRATION; GUEST CHECKOUT

In order to place an order, you or the Panerai Ambassador (on your behalf) may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to “I have read and I accept the Conditions”. Then, place your order. Notwithstanding anything to the contrary provided for herein, Panerai reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Panerai may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if Panerai suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Conditions of Sale or the policies incorporated herein by reference.

PRICES, TAX AND SHIPPING COSTS

All prices shown on the product pages of the Website or quoted by the Client Relations Center are in Australian Dollars. Panerai reserves the right to modify prices and delivery costs at any time without prior notice. The price of and delivery costs displayed on the Website or quoted by the Client Relations Center, at the time Panerai provides you with a Confirmation of Order will be honored by Panerai. Actual shipping costs and applicable taxes will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options. Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. PAYMENT

We accept the methods of payment offered on the Website or through the Client Relations Center. When ordering on the Website, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your credit/debit card number and your three or four digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID).All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Panerai, you will need to contact your card issuer directly to solve this problem. In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is shipped to the shipping address you have provided to Panerai, at which point in time you will be sent a Confirmation of Order and your credit card will be charged the applicable purchase price. By submitting an offer to purchase Panerai products on the Website or through the Client Relations Center, you expressly authorize Panerai to perform security checks, where Panerai deems necessary, to transmit or to obtain information (including any updated information)about you to or from third parties from time to time, including but not limited to your credit-card number, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions. Where we offer PayPal/PayPal Express/Alipay/WePay as a payment method, the full amount of your purchase may be taken immediately following the placement of your order. PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Cartier will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order.

These Conditions of Sale will be provided to you with the Acknowledgement of Order. Please carefully review these Conditions of Sale upon receipt.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

For example, Panerai may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if Panerai suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Conditions of Sale or the policies incorporated herein by reference.

PRICES, TAX AND SHIPPING COSTS

All prices shown on the product pages of the Website or quoted by the Client Relations Center are in Singapore Dollars. Panerai reserves the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the Website or quoted by the Client Relations Center, at the time Panerai provides you with a Confirmation of Order, will be honored by Panerai. Actual shipping costs and applicable taxes will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options. Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. If the resulting change is an increase in the sales tax you are charged, we will contact you and ask that you reconfirm your purchase.

PAYMENT

We accept the methods of payment offered on the Website or through the Client Relations Center. When ordering on the Website, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your credit/debit card number and your three -or four- digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID).All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Panerai, you will need to contact your card issuer directly to solve this problem. In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is shipped to the shipping address you have provided to Panerai, at which point in time you will be sent a Confirmation of Order and your credit card will be charged the applicable purchase price. By submitting an offer to purchase Panerai products on the Website or through the Client Relations Center, you expressly authorize Panerai to perform security checks, where Panerai deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions. Where we offer PayPal/PayPal Express/Alipay/WePay as a payment method, the full amount of your purchase may be taken immediately following the placement of your order. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer.Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Panerai will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. These Conditions of Sale will be provided to you with the Acknowledgement of Order. Please carefully review these Conditions of Sale upon receipt.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them.The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Singapore. Please note that Panerai does not ship to military or certain restricted areas, or hotels. Boutique pick-up may be offered, free of charge, to certain locations. Please refer to the Website or call the Client Relations Center for more information. Panerai will inform you by email or by telephone when the product is ready for pick-up at the boutique. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you. If we offer delivery to a locker and you have chosen this delivery method on the Website or through the Client Relations Center, you will be provided with a confidential code to open it. You must keep this code confidential and secure at all time. You understand and accept that entry of this code into the locker will be evidence of the delivery of the product and fulfillment of the sale contract by Panerai.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to you in writing (to your email address as a .pdf attachment or otherwise). You may also at any time later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may berejected by Panerai and will be sent back to you.


 

17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased onthe Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Products that have been purchased on the Website or through the Client Relations Center may only be returned to the Panerai e-boutique distribution center at the address of the Panerai Returns Department, as provided by the Panerai Client Relations Center, or in selected Panerai retail boutiques, in accordance with these Conditions of Sale. Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

      i)         Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner Roadbull. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii)         The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii)         Please, fill out the required information on the Return Form and sign it,

    iv)         You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v)         Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi)         On the agreed date, Roadbull will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Conditions of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

  

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded. Should a product be returned to a Panerai retail boutique, the individual making the return will only be entitled to receive boutique merchandise credit. No cash or credit card refunds will be issued in respect of a return to a Panerai retail boutique. Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale.In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. Should a product be returned for exchange to a Panerai retail boutique for exchange with a less expensive product, the individual making the return will only be entitled to receive merchandise credit of the price difference. Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

MANUFACTURER’S GUARANTEE

Panerai is extremely cautious in ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic. Selected products are covered by the Panerai International Guarantee. If you wish to repair a product covered by the Panerai International Guarantee, please refer to the Panerai International Guarantee, and call our Client Relations Center for more information.

If you receive a product that is covered by the Panerai International Guarantee and seems to have defects originally caused by Panerai (originally defective), please return it to Panerai in accordance with the return process above.

LEGAL GUARANTEE

In your capacity as consumer, you may have legal rights under applicable national legislation governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale.

For any repair inquiries relating to a product ordered online, please contact our Client Relations Center (telephone number and email address indicated on the Website).

ACCURACY OF PRICING, PRODUCT DESCRIPTIONS

While Panerai endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Center, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Panerai does not confirm the price of a Panerai product until an Order Confirmation has been issued by Panerai, indicating the existence of a binding sales contract. If a Panerai product’s correct price is higher than the price posted on our Website, then Panerai will either contact the Customer for instructions before shipping the order or, if Panerai cannot obtain your instructions, reject the order and notify you of such rejection. If the order is rejected and you have already paid for the product, you will receive a full refund.

FINAL PROVISIONS

Information and complaints. In case of any inquiry or complaint please contact our Client Relations Center on the telephone number and email address indicated on the Website.

Entire Agreement. The Conditions of Sale, including policies incorporated herein (e.g., Privacy Policy) constitute the entire agreement between you and Panerai regarding your purchase of Panerai products through the Client Relations Center or the Website, and supersede any prior conditions of sale.

Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.

GOVERNING LAW

These Conditions of Sale shall be governed by and construed in accordance with the laws of Singapore.

JURISDICTION

The courts of Singapore shall have exclusive jurisdiction over any disputes arising out of or in connection with these Conditions of Sale. Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.
